Binding Agreement & Acceptance
Welcome to Swastika Learning Platform (operating as Swastika Business School / Swastika Learning P, hereinafter referred to as “Swastika”, “Company”, “We”, “Us”, or “Our”). Our website is https://swastikalearningplatform.com/.
These Terms and Conditions (“Terms”) constitute a legally binding electronic agreement under the Indian Contract Act, 1872 and the Information Technology Act, 2000 between you (“User”, “Learner”, “Candidate”, or “Partner”) and Swastika. By registering on, browsing, or accessing our website, training programs, or the WorkPool Talent Application, you explicitly accept and agree to abide by these Terms.
User Eligibility & Representations
To use our services, you represent and warrant that:
- You are at least 18 years of age or possess legal capacity under Section 11 of the Indian Contract Act, 1872. If you are under 18, you may use the services only under the active supervision of a parent or legal guardian.
- All registration details, credentials, educational backgrounds, and documents submitted during enrollment or WorkPool onboarding are true, complete, and authentic.
Programs & WorkPool Platform Rules
Swastika provides experiential education, capability training, and talent platform services:
- Educational Offerings: X Program, Course cum Internship (Sankalp), and Corporate Training (Nirnay). Schedules, curriculum modules, and mentor availability are subject to operational updates.
- WorkPool Talent Marketplace: WorkPool acts as a performance matching engine connecting candidates and corporate hiring partners based on verified project proof. Candidate profiles and skill badges reflect performance evaluation records.
Fees, GST Compliance & Refund Policy
Program fees are payable in Indian Rupees (INR) through authorized RBI-regulated banking channels and payment gateways. Fees are exclusive or inclusive of applicable Goods and Services Tax (GST) as specified during checkout.
Enrollment fees paid for training cohorts or specialized tracks are non-refundable once the course materials or live orientation sessions commence, unless explicitly stated otherwise in a signed program-specific enrollment agreement.
Intellectual Property Protection
All courseware, lecture recordings, case studies, website graphics, source code, project briefs, and trade dress are protected under the Copyright Act, 1957 and the Trademarks Act, 1999 of India. All rights are reserved exclusively by Swastika.
Prohibition: Users may not record, redistribute, publish, sell, or reverse engineer any platform content without prior written authorization from Swastika.
User Conduct & Penal Provisions (IT Act Sec 66)
Users shall not engage in unauthorized activities prohibited under Section 66 of the IT Act, 2000, including:
- Submitting fraudulent project assignments, plagiarized code, or forged academic credentials.
- Attempting to gain unauthorized access to administrative databases, student profiles, or API keys.
- Posting defamatory, harassing, obscene, or unlawful content on public discussion boards or community groups.
Disclaimer: No Employment Guarantee
Swastika provides practical skill development, live project exposure, and performance-based hiring pipelines (such as X Program and WorkPool). While we connect top-performing candidates with hiring partners, Swastika does not make any unconditional guarantee or guarantee of job placement, fixed compensation, or employment contracts. Placement outcomes depend strictly on individual candidate evaluation performance and corporate partner requirements.
Limitation of Liability & Indemnity
To the maximum extent permitted by Indian Law, Swastika’s total cumulative liability for any claims, losses, or damages shall be limited to the actual fee amount paid by the user to Swastika in the preceding 6 months.
You agree to indemnify, defend, and hold harmless Swastika, its directors, officers, and employees against all third-party claims, liabilities, and expenses arising from your breach of these Terms or violation of applicable laws.
Governing Law & Dispute Resolution (Arbitration)
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of India. Any dispute or difference arising out of or in connection with these Terms shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Raipur, Chhattisgarh, India. The language of arbitration shall be English.
Subject to arbitration, Courts situated in Raipur, Chhattisgarh, India shall have exclusive jurisdiction over any legal proceedings.
